Personal Injury Case Study
Head Injury and Restraint Use

Issue:
A Ford minivan traveling approximately 30 mph through an intersection was struck behind the driver’s door by a Dodge sedan traveling approximately 40 mph.  At impact, the change in velocity of the minivan was estimated at between 22 and 24 mph.  As a result of the collision, the minivan rotated and rolled onto its right side, and the driver’s side third row passenger suffered a right side skull fracture.  Was the passenger restrained at the time of the incident?  Would restraint use have prevented the injury?

Head Injury and Restraint Use

Results:
At impact, the occupants of the minivan would have moved in response to the impact motion of the van.  Northstar Biokinetics determined that the rear-seat passenger’s motion would have been forward and to the left as the van slowed and rolled to the right.  As a result, the passenger’s right-side head strike could only have occurred from falling across the van when it rolled onto the right side.  If the rear-seat passenger had employed the available three-point restraint, impact would have been minimal to his left side.  Northstar Biokinetics concluded that the right-side head strike and resultant head injuries were the direct result of not wearing the restraint.
